Terms and conditions of service
1. Registration
a. It is important to Narrowboats.org that we are able to contact you, and it is therefore a requirement of being registered to use Narrowboats.org Forum that you provide us with your full current email address. Please note that your email address must be personal to yourself.
b. You confirm that you will not permit any other person to use the Narrowboats.org Forum by using your email address and password.
2. Use of material posted on our websites
a. Narrowboats.org has an absolute discretion whether or not to remove the contents of any post which is filed on the Narrowboats.org Forum or any other website.
b. For the avoidance of doubt, the contents of any post on the Narrowboats.org Forum or websites remains the sole responsibility of the individual user.
c. Narrowboats.org has the right, at Narrowboats.org’s sole discretion, to make any amendments, additions, deletions from any post.
3. Posting content on the Narrowboats.org Websites.
a. You confirm that the material you have submitted is your own original work and that you own the copyright and all other intellectual property rights in that work. In addition you grant to Narrowboats.org a non-exclusive, royalty free, worldwide, perpetual license to use the contents of the post in any manner Narrowboats.org considers appropriate.
b. You will fully indemnify Narrowboats.org for all costs, damages, expenses, including legal costs which it suffers as a result of any third party successfully claiming that the contents of your post infringes any copyright, trademark, trade secrets, or any other intellectual property rights of any third party. In addition you will indemnify Narrowboats.org in respect of all costs, damages, expenses etc. it suffers as a result of any other claim brought by a third party.
4. Termination of your right to post content.
a. Please remember that it is never acceptable to post material which is disruptive, abusive, and in any way offensive. The following is a non exhaustive list which contains examples of posts which will not be permitted and which will be deleted:-
i. Offensive content, such as sexually explicit or indecent comments, obscenities, and profanities;
ii. Any content which is potentially defamatory;
iii. Any blog which either is intended or has the effect of causing distress, annoyance, inconvenience to any person or group of persons, or is intended to cause disruption to the normal flow of dialogue on the Narrowboats.org Forum;
iv. Messages which condone, promote or encourage any illegal activities of any nature;
v. Spamming, that is the submission of the same or very similar contributions many times over;
vi. Spamming, that is the submission of the same or very similar contributions from many times over, including any post which contains software viruses, malware, or any disabling codes or the like;
vii. Advertising, marketing or campaigning in relation to any commercial, political or other enterprise;
viii. Any post which breaches the copyright or other intellectual property rights of any third party worldwide.
ix. Any post which in Narrowboats.org’s reasonable opinion is inappropriate to remain on any Narrowboats.org website.
b. Once your permission to post on to Narrowboats.org’s Forum and website has been terminated we will notify you of that fact by sending to you an email to the email address which you have registered with Narrowboats.org. Immediately thereafter your email address and password will be invalidated.
5. User Names
For the avoidance of doubt please note that any user name which breaches any of the above mentioned rules will be deleted from the site.
6. Language
Please note that in view of the fact that Narrowboats.org is predominantly a United Kingdom based retailer, it is regretted that only postings in English are acceptable and no foreign language postings will be permitted.
7. Confidentiality (Data Protection)
a. Please refer to our privacy policy. Narrowboats.org never releases your personal details to any Company outside Narrowboats.org for mailing and marketing purposes.
b. You have the right to request a copy of any information that Narrowboats.org hold on you at any time and have that information corrected if it is inaccurate. If you wish to view any information you have submitted please contact Narrowboats.org.
8. Limitation of Liability
a. The Narrowboats.org Forum is unable to provide you with any warranty that the contents of the Forum is virus free and accordingly it is essential that you take your own precautions in this respect. Narrowboats.org does not accept liability with regard to any virus, disabling code, or any other contamination which will adversely impact upon your computer.
b. Please note the contents of this website are not intended, to be used commercially or in substitute for any professional advice. As a result Narrowboats.org does not accept any responsibility for the contents of any of the material which appears on the Narrowboats.org Forum site.
c. You are able to access other sites from the Narrowboats.org Forum. For the avoidance of doubt these sites are not in any way influenced or controlled by Narrowboats.org. Accordingly Narrowboats.org cannot accept any liability for contents of those external sites.
d. Any advertising material placed upon the site by a third party remains the sole responsibility of that third party and Narrowboats.org cannot be held responsible for the contents of any advertising material which appears on the Narrowboats.org Forum site.
9. Notices
Any notice or other communication given to Narrowboats.org is required to be served by first class post or facsimile transmission to the Registered Office of Narrowboats.org.
10. Severability
If any part of this Agreement is found by a Court of competent jurisdiction or other competent authority to be invalid unlawful or unenforceable then such part will be severed from the remainder of these Terms and Conditions and the Terms and Conditions will continue to be valid and enforceable to the fullest extent permitted by Law.
11. Waiver
No delay or failure by Narrowboats.org to exercise any of its powers, rights or remedies under these Terms and Conditions will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights, or remedies preclude Narrowboats.org from further exercise of them. Any waiver to be effected must be in writing and signed on behalf of Narrowboats.org. The remedies provided in these Terms and Conditions are cumulative and not exclusive of any remedies provided by Law.
12. Variation
These Terms and Conditions may at Narrowboats.org's absolute discretion be varied from time to time. It is your responsibility to ensure that you view the Terms and Conditions on each and every occasion that you access the Narrowboats.org Forum to ascertain whether any variation in these Terms and Conditions has been effected. For the avoidance of doubt, all variations are fully enforceable as against you immediately they appear on the Narrowboats.org Forum website.
13. Force Majeure
Narrowboats.org will use its reasonable endeavours to ensure that you will always have access to the Narrowboats.org Forum. Unfortunately Narrowboats.org cannot guarantee that you will always have access to the Forum, nor that your access will be uninterrupted or error free. Narrowboats.org therefore accepts no responsibility or liability for any interruption or lack of access to the Forum.
14. Third Parties
The provisions of the Contracts (Rights of Third Parties) Act 1999 are hereby excluded in their entirety.
15. Governing Law
These Terms and Conditions are construed in accordance with and governed by the Law of England and Wales, and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales regarding any dispute with Narrowboats.org.
